Palestinian refugees who filed under a program designed for Ukrainians escaping the conflict against Russia were granted permission by a court to reside in the United Kingdom.
According to reports, the Gaza family of six a mother, father, and four children ages seven to eighteen applied to the Ukraine Family Scheme in an attempt to join their brother who was already residing in the UK, but their application was denied by the Home Office.
The family's human rights were violated by this rejection, according to a recent ruling by an immigration judge.
According to the Telegraph, Home Office attorneys warned that this case could lead "to the admission of all those in conflict zones with family in the UK," yet the decision was made.
According to shadow home secretary Chris Philp, this case demonstrated the need for amendments to human rights legislation so that Parliament, not individual judges, would decide who is allowed to reside in the UK.
Following an airstrike that destroyed their home in Gaza and ongoing attacks in the refugee camp where they were staying, the family claimed that the Ukraine Family Scheme was the best option for their situation.
If they have a relative who is a UK citizen or has resided in the country, the program enables Ukrainians and their family members to seek asylum in Britain.
Almost two years after it was established in March 2022, it closed last February.
The family apparently claimed that because their circumstances were so "compelling and compassionate," their application, which was filed in January 2024, should be approved even though it violated the scheme's guidelines.
The claim was initially denied by an immigration tribunal on the grounds that the Palestinian family's circumstances were not covered by the Ukrainian system.
